The International Bar Association (IBA) released the updated Guidelines on Conflicts of Interest in International Arbitration (the “2024 IBA Guidelines”).
This latest update to the 2024 IBA Guidelines brings significant changes to both the “General Standards” and the list of practical applications. While the fundamental essence of the guidelines remains unchanged, additional examples of circumstances that require arbitrator disclosure have been included in the “Orange List”.
The 2024 IBA Guidelines continue to uphold the highest standards of ethics and professionalism in arbitrator practice.
The 2024 IBA Guidelines reinforce the importance of impartiality, independence, and disclosure in international arbitration. They reflect changes in modern legal practice, including arbitrators being employees and the role of third-party entities in arbitration.
