SAMR: Pilot Entrusted Anti-Monopoly Review of Certain Cases Involving the Concentration of Operators

On July 15, The State Administration of Market Regulation (SAMR) issued the Announcement on Piloting the Entrusted Anti-Monopoly Review of Certain Cases Involving the Concentration of Operators (the “Announcement”), implementing a pilot program of entrusting the Administration of Market Regulation (AMR) of Beijing, Shanghai, Guangdong, Chongqing, and Shaanxi to carry out anti-monopoly reviews of certain cases involving the concentration of operators. The Announcement will further enhance the effectiveness of anti-monopoly reviews of operator concentration.
During the pilot period, certain cases that are subject to the summary procedures involving the concentration of operators and which meet any of the following criteria will be entrusted to AMR: (i) at least one declarer is domiciled in the relevant areas where AMR are entrusted; (ii) where an operator acquires the right to control another operator by purchasing the equity or asset, and the other operator is domiciled in the relevant areas; (iii) where the operator newly establish joint ventures, and such joint ventures are located in the relevant areas; (iv)the relevant geographic market of the concentration of operators is a regional market and such relevant geographic market is wholly or mainly located in this relevant area; (v)other cases entrusted by SAMR.
