AllBright Client Wins Adjustment to Lowest Anti-Dumping and Countervailing Duties
2013-03-045753On February 19, 2013, the US Department of Commerce announced its affirmative final determinations in the anti-dumping duty (AD) and countervailing duty (CVD) investigations of imports of drawn stainless steel sinks from China. Guangdong Dongyuan Kitchenware Industrial Co., Ltd, which is represented by the AllBright Beijing office, had its combined rate of AD and CVD adjusted to the lowest rate among all Chinese companies.
The Chinese sink anti-dumping and countervailing duty investigation was the first case after the US Department of Commerce modified its calculation methods on AD and CVD proceedings. Guangdong Dongyuan is the first Chinese company whose duties have been cut by the Department. Another Chinese respondent of the case had its appeal rejected by the Department.
During the case, AllBright provided vast amounts of information on the effect to procurement, cost, sales and price of the requirements of the new US commerce law and its interpretations. This evidence was validated by US officials’ onsite inspections and convinced them to accept the appeal to cut the AD and CVD rates in the final ruling. The outcome of the case will set an example for the US Department of Commerce to standardize its practices in investigating AD and CVD cases in China, as well as Chinese companies’ responses in these proceedings.
